1) Object and scope of application.

The purpose of these Terms and Conditions is to regulate the relationship between María Rosa Navarro Pastor (hereinafter Nicte or the Company), with tax domicile at Plaza Honduras 26 bajo 46022 Valencia (Spain), and N.I.F. No. 44519229S, and You (hereinafter the Client), relating to all transactions made on the website located at www.nicte.shop (hereinafter, the “Online Store”). 2) Definitions.

“Contractual Documents of the Site” .- The term includes these Terms and Conditions, the Privacy Notice, the Delivery Policy, Returns and Cancellations; In general, the term also includes any other contract, agreement, notice or policy that the Company issues and publishes from time to time and that is applicable to transactions carried out through the Online Store.

“Online Product Catalog” or “Catalog.” – Consists of all merchandise, gift certificates and, where applicable, services that are available in the Online Store, items in the Catalog are not necessarily available or in existence at the time an Order is placed, and may be changed, replaced or discontinued from time to time at the Company’s discretion.

“Confirmation of Purchase” .- It is the data message generated by the Online Store in which the Company expresses its acceptance to fill the Order offered by the Customer. The Purchase Confirmation confirms that the Company has sold and the Customer has purchased the corresponding items and records the time of purchase. The message includes an order number so that the Customer can monitor the delivery of your order.

3) Acceptance of the order.

The acquisition of the products must be done through the activation of the button “CONFIRM ORDER” that appears at the foot of the page of the purchase request, and expresses the total acceptance of each and every one of the Terms and Conditions as shown in the web page of NICTE prior to the acquisition of the products, without it being applicable the news that may occur in the clauses of the terms and conditions later.

From the moment of acceptance, the user acquires the status of Client of the Company that is described in these terms and conditions. Any product or service subsequently offered by NICTE must be the subject of a new contract.

If the Client wishes to read the terms and conditions in more detail, he may print on paper or save the document in electronic format.

NICTE informs you that it files the electronic documents in which the purchases are formalized.

In case the Client made an error when sending the data, he / she will be able to modify them in the MY ACCOUNT section and will be taken into account for future acquisitions. In case the error occurs in the current order, the Customer should contact the Customer Service.

Once the order is accepted, the preparation time of the product or products can vary from 7 to 10 working days depending on the characteristics and complexity of the articles of the order.

4) Shipping information.

Regardless of the item or items that you buy through the Online Store, the default shipping method is through Correos de España. The shipping costs, when applicable, are calculated automatically during the payment process, before finalizing the order.

Any errors in the address indicated by the buyer will not be the responsibility of Nicte.

a.- Delivery locations:

We currently ship orders internationally. We do not perform post office boxes.

b.- Deadlines and delivery costs:

**IMPORTANT NOTE** Due to the COVID-19 pandemic, worldwide couriers are suffering from SERIOUS limitations and restrictions on the movement, storage, and flow of goods. Also Customs have been directly affected. That means most of the shipment may be delayed. Some packages experience delays of more than 50 working days. Once you place your order, NicteShop will provide you with a tracking number, so you can track your package. Nicte is not responsible for shipping delays once your order is shipped. In some cases, tracking may no longer be available for international orders once the package leaves Spain. Once an order has been shipped, Nicte has no control over shipping delays and has no more information than can be found through its tracking number.

Upon shipping, you will receive a notification email from Nicte where a tracking link is provided. Once the order has arrived in your country, you can check with your nearest post office about the status of the shipment with the tracking number that we will provide you. The average delivery timeframes* are:

c.- Customs and import taxes:
Buyers are responsible for any customs and import taxes that may apply. Nicte is not responsible for delays due to customs.

5) Tracking and order history.

If you have an account at www.nicte.shop you can track your orders by visiting “My Account” and clicking on “View my orders”. There you can see your previous orders or see the status of your current order.

If you do not have an account, please contact our Customer Service Department, who will do everything possible to inform you about the status of your request.

6) Product review.

Keep in mind that you assume the risk of the products you have ordered once the shipment is completed. If the packaging is damaged, please do not accept the shipment. Without prejudice to your rights, you are responsible for inspecting the product and notifying us of any complaint. In the case of defective products or disagreement with your request, you have the option to return the defective product and we will refund the purchase price and all shipping costs once the item arrive to us and we check everything is correct. We reserve the right to request photographic evidence of the defective order.

Conditions of return
Buyers are responsible for return shipping costs and any additional charges due to customs. If the item is not returned in its original condition, the buyer is responsible for any loss in value.

7) Availability and validity of the order.

In the case that you ask us for products that are not in stock, we reserve the right not to accept the order. You will be informed by email and any other payment, of course, will be returned.

The prices that appear on the website are valid at the time they occur, unless other specific terms on the website indicate otherwise. Price errors or spelling errors may occur.

8) Orders.

The Online Store is open 24 hours a day. However, the store can be closed for maintenance. For your convenience, we strive to perform such work at night.

To make purchases at www.nicte.shop you must be at least 18 years of age and have a payment method accepted by us, described in section 12 of these terms.

We can cancel a purchase in any of the following situations, without being responsible for any damage or cost. We will notify you by email before any action, to try to resolve the problem and return any payment made:

  • Your order may have been made for fraudulent purposes, or in connection with a crime or other illegal activity;
  • An inadvertent error has occurred in the Online Store, for example a payment error, etc .;

  • The order could not be delivered to the address provided by you;

By placing an order in our Online Store, you make us an offer to purchase the products you have selected in these terms and conditions. We can accept or not accept the offer at our discretion.

We can only accept offers that are made through our Online Store. We can not accept orders placed by phone, email, letters or fax.

If a product different from the one requested by the customer was delivered by mistake of NICTE, the correct product will be delivered, without any additional charge for the Client, as long as the Customer notifies within 7 working days of the problem and refers to our installation of the wrong product, with NICTE assuming the cost of the erroneous order shipping costs, prior to the Customer providing the invoice or receipt that specifies the cost of shipping to our facilities.

If a product has reached the broken, damaged or damaged customer, the process is as follows:

At this point, two situations can occur:

b. Refund of the cost of the product.

9) Formalization of the purchase.

It is formalized at the moment of clicking on “CONFIRM PURCHASE” and after the receipt that is shown on your screen, you agree to make the purchase.

If you made an error when placing the order, please contact our Customer Service Department who will be happy to assist you. However, please always be sure to review your offer before placing the order.

10) Policy of changes and / or returns.

10.1. Returns & Exchanges.

If for any reason the Customer is not satisfied with the product purchased at www.nicte.shop, for reasons of hygiene, NICTE does not accept unjustified returns.

In any case, if the purchased item is not of your full satisfaction, the return will be accepted and it will be exchanged for a purchase voucher of the same amount and the customer will assume the return of the product and any additional charges due to customs. Consequences of withdrawal

In case of withdrawal, we will refund all payments received after the purchase, including shipping costs without any undue delay and, in any case, no later than 14 calendar days from the date you inform us of the decision of to withdraw from this contract. We will proceed to make said refund using the same means of payment used by the client for the initial transaction.

We can retain the refund until we have received the goods. You must return or deliver directly the goods without undue delay and, in any case, no later than within 14 calendar days from the date you notify us of your decision to withdraw from the contract. The deadline will be considered fulfilled if the goods are returned before the end of that period.

Under the responsibility and charge of the buyer, the piece/s must be in perfect conditions and in its/their original packagings.

In the event that it exercises the right of withdrawal, it will only be liable for the decrease in the value of the goods resulting from a manipulation of the same, different from that necessary to establish its nature, characteristics or operation.

11) Fraud check.

In order to protect our customers and maintain the security of buying online, we can verify the data you provide when you submit an order. These controls may include address verification and payment method to prevent fraud.

15) Minors.

16) Photographs.

NICTE guarantees the quality of the service contracted through the Online Store.

All the rights that the laws in force guarantee to consumers and users are guaranteed.

Failure to comply with any of these Terms and Conditions may result in the return of the products or cancellation of the Services purchased by the Customer.

20) Customer Responsibilities.

It is the responsibility of the Client to make a lawful use of the Services, without contravening the current legislation, or injuring the rights and interests of third parties.

The Client guarantees the veracity and accuracy of the data provided when filling in the contract forms, avoiding causing damage to NICTE, as a result of the incorrectness of the same.

Failure to comply with any of these terms and conditions may result in the withdrawal or cancellation of the Services by NICTE without prior notice to the Client and without giving any right to compensation.

21) Guarantees.

NICTE, will respond to the Client for any lack of conformity that the deliveries manifest within a period of two years, as established by current regulations. The warranty regarding any damage caused by use or improper use is excluded, as well as in general those excluded by current legislation.

22) Jurisdiction and applicable Law.

The relationship between NICTE and the Client will be governed by current Spanish regulations and any dispute will be submitted to the Courts and Tribunals of the Client’s domicile.

The Company will pursue the breach of these Terms and conditions as well as any improper use of the website by exercising all civil and criminal actions that may correspond to and assist in law.
